Uncontested Divorce

We encourage amicable resolutions of divorce and family disputes where feasible.  Married couples in New York may now obtain a divorce by swearing to the Court that the relationship between the couples has irretrievably broken down for a period of six months prior to the commencement of the divorce. This is commonly referred to as a “no fault” divorce.

Other grounds for divorce are:

• Abandonment (Actual & Constructive)
• Adultery
• Conversion of a separation judgment
• Conversion of a written and acknowledged separation agreement after living separate and apart for more than one year
• Cruel and inhuman treatment
• Imprisonment for more than three years subsequent to the marriage
